There has been a dramatic increase in the use of agency workers in recent years, with 80% of organisations using temporary labour. The UK employs by far the highest number of agency workers in the European Union and with the credit crunch starting to bite, this increase is set to continue as these ‘workers’ provide businesses with unique flexibility.
But the use of temporary staff does not come without risks. In recent years several key cases have highlighted the existence of ‘implied contracts’ between the employer and the ‘temporary’ worker, leading to significant pay-outs.
Agency worker rights took a significant step forward when the Government, TUC and CBI issued a joint statement pledging equal treatment for agency workers in basic working and employment conditions once they have been in a job for 12 weeks. With the implementation of the Agency Workers Directive likely in 2010, HR must ensure their businesses are well prepared.
